The approximately 23-acre parcel in Barstow that is the subject of the Los Coyote Band’s fee-to-trust and two-part determination application is approximately 115 miles from the Los Coyotes reservation. It is important to note, however, that 51% of the adult Tribal members living in California live within a “commutable distance” to (i.e., within a 70-mile radius of) Barstow. This is more members than those who live on or in reasonably close proximity to the reservation. It therefore meets the standard set forth by the Department of the Interior in 2008 in what has come to be known as the “Artman Guidance” (because it was embodied in a memorandum signed by a former administration official named Carl Artman) or the “commutability test.”
The Los Coyotes trust parcel was selected with the City’s direct input into the most appropriate gaming location for the City. The parcel is located within the incorporated boundaries of the City of Barstow, San Bernardino County, California, just east of Interstate 15.
